1. General Provisions
1.1. These terms and conditions (“Terms”) apply to all legal relationships, offers, orders, and sales transactions between the user (“Client”) of the online store www.safalkids.ee (“E-store”) and its owner, Lava OÜ (“Online Store”), registration code 12058217, located at Sisaski 13a, Tallinn 10913.
1.2. In addition to these Terms, the legal relationships arising from the use of the E-store are governed by the laws of the Republic of Estonia.
1.3. The Online Store may change the Terms at any time. Changes will be published on the website www.safalkids.ee and take effect immediately upon publication. By using the E-store and placing an order, the Client confirms acceptance of the Terms.
2. Prices
2.1. Prices in the E-store are in euros and include the applicable Estonian VAT (22%).
2.2. Prices do not include product shipping costs. Shipping costs are displayed in the E-store before making a purchase, allowing the Client to review them.
2.3. If the Client orders a product from outside the European Union, import duties and taxes may apply upon the product’s arrival in the destination country. Such fees are the responsibility of the Client. Tax and customs policies vary by country; therefore, the Online Store recommends that the Client familiarize themselves with potential additional fees before ordering.
2.4. The Online Store may change the prices displayed in the E-store at any time. All changes will be published on the website www.safalkids.ee and take effect upon publication.
2.5. If the Client’s order is placed before a price change is published, the price valid at the time of purchase applies to the Client.
3. Placing an Order and Payment Termsd
3.1. To place an order, select a suitable product from the E-store and click “Add to cart.” By clicking “Checkout,” you can view, modify quantities, or remove products in the cart. On the same page, shipping costs and the total amount (including VAT) are displayed.
3.2. When placing an order, the Client is required to enter their details—name, email address, company (if the invoice is for a business), shipping address, and phone number. Additionally, delivery notes can be added if desired (e.g., preferred location for parcel machine delivery). The Client must verify payment and delivery information, as the prompt and problem-free delivery of products depends on the accuracy of the information provided by the Client.
3.3. Payment for the product can be made via bank link upon exiting the Online Store. Payments are processed by Maksekeskus AS. The Client pays 100% of the product price when confirming the order. Bank links are available for the following banks in Estonia: Swedbank, SEB, Luminor, LHV, Coop Pank, and Pocopay.
3.4. The agreement is concluded when the payment reaches the Online Store’s bank account.
4. Product Deliverye
4.1. The Online Store delivers products to the Client using parcel machine services—Smartpost, Omniva, or DPD. The Online Store notifies the Client via email when the product has been dispatched.
4.2. Product delivery by mail typically takes 7-9 days within European countries and 21 days elsewhere in the world. Delivery via parcel machine takes 1-2 days. If the product has not arrived within this time frame, please inform us. The Online Store is not responsible for delays or issues arising from inaccuracies in the information provided by the Client when placing the order.
5. Product Returns
5.1. After receiving the product, the Client has 14 days to familiarize themselves with it. If the Client is not satisfied with the product for any reason, they have the right to return it within 14 days by notifying the Online Store via email at tere@safalkids.ee.
5.2. The returned product must be in its original packaging and in the same condition as when it reached the Client. The Client must ensure that the returned product is unused and in good condition. “Unused” means that the product must not show any signs, marks, or damages that were not present when it reached the Client. If the product is returned to the Online Store with signs of use, the Online Store will seek compensation from the buyer for the decrease in value.
5.3. The Online Store does not accept returns of personalized products (e.g., items with names or custom designs). These products are final sales, and no refunds are provided.
5.4. If the Client returns the product in accordance with clauses 5.1 and 5.2, the Online Store will refund the Client the product cost and shipping fee. The cost of returning the product is borne by the Online Store.
6. Privacy Policy
6.1. The Online Store uses the personal data provided by the Client only to process the order and send the product to the Client.
6.2. The Online Store transmits personal data to transport service providers to ensure product delivery.
6.3. The Online Store sends newsletters and offers to the Client’s email address only if the Client has expressed a desire to receive them by entering their email address on the website and indicating their wish to receive direct mail notifications.
6.4. The Client can unsubscribe from email offers and newsletters at any time by notifying us via email or by following the instructions in the email containing the offers.
7. Liability
7.1. The Online Store is liable to the Client, and the Client is liable to the Online Store for damages caused to the other party by violating these Terms in the cases and to the extent provided by the legislation of the Republic of Estonia.
7.2. The Online Store is not liable for damages caused to the Client or delays in product delivery if the damage or delay is due to circumstances beyond the Online Store’s control, which the Online Store could not foresee or prevent (force majeure).
8. Dispute Resolution
8.1. If the Client has any complaints regarding the Online Store, they must be sent to the email address tere@safalkids.ee.
8.2. If the Client and the Online Store cannot resolve the dispute through negotiations, the Client has the right to turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority. The Client can review the procedural conditions and submit a complaint here. The committee is competent to resolve disputes arising from contracts between the Client and the Online Store. The review of complaints by the committee is free of charge for the Client.
8.3. If the Client is located in the European Union, they can also submit a complaint via the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/odr.
9. Final Provisions
9.1. These Terms and Conditions are governed by the laws of the Republic of Estonia.
9.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9.3. If necessary, the Online Store has the right to modify the Terms at any time. Changes take effect once they are published on the website. The Terms applicable to the Client are those in force at the time of placing the order.
